These Terms and Conditions of Use (hereinafter "T&C") govern access to and use of the website (hereinafter the "Site"), published by Novacare Technologies association.
By browsing this Site, the user (hereinafter the "User") accepts these T&C without reservation.

Publisher: Novacare Technologies Association, Swiss law association (art. 60 et seq. of the Swiss Civil Code), currently being registered in the Commercial Register.
Headquarters: Canton of Vaud, Switzerland.

Hosting & Data
Hosting: The Site is hosted in Switzerland by Infomaniak Network SA (Rue Eugène-Marziano 25, 1227 Les Acacias, Geneva).
Certifications: ISO 27001 (Information Security), ISO 9001 (Quality), ISO 14001 & 50001 (Environment).
Guarantee: Data passing through this Site is stored exclusively on Swiss territory, in accordance with the strictest security standards.
Purpose of the Site
The Site aims to present the Nova Care integrative health ecosystem, its scientific approach derived from research (INSERM/University of Bordeaux), its decentralized governance model (DeSci) and its membership offers.
The Site serves as an information and application portal. It does not constitute, in itself, the telemedicine tool or monitoring application (which are subject to separate conditions).

Information vs Consultation:
The information provided on the Site (articles, AI descriptions, protocols) is for informational and educational purposes only. It in no way replaces a medical consultation, diagnosis or treatment established by a doctor during a physical examination.
AI Limitations:
The "Copilot" Artificial Intelligence presented on the Site is a tool to help prevent and monitor risk factors (sleep, stress). It does not substitute for the clinical judgment of a healthcare professional.
Emergencies:
In case of medical emergency, the User must not use the Site or wait for a response via the contact form, but immediately dial 144 (Switzerland), 112 (Europe) or go to the nearest emergency room.
Access to "Nova Circle" (Membership)
Application Process
Access to care services (The Oasis, The Application) is subject to a selection process (Vetting). Filling out a form on the Site does not guarantee immediate admission. Novacare Technologies reserves the right to direct an application to a waiting list if the reception capacity of our cohorts is reached.
"Pioneer" Model
The User acknowledges that certain offers presented (notably access subsidized by research) are subject to specific medical eligibility criteria and the availability of scholarships funded by our partners.
Intellectual Property
All content (texts, structure, "GPS Health" methodology, logos, videos) is the exclusive property of Novacare Technologies Association or its academic partners and is protected by copyright. Any reproduction without authorization is prohibited.
Data Protection (nFDPA & GDPR)
Novacare Technologies applies a strict privacy policy, compliant with the Swiss New Federal Data Protection Act (nFDPA) and European GDPR.
Swiss Hosting:
Under our contract with Infomaniak, your personal data collected via the Site is hosted on secure servers located in Switzerland and is not subject to any transfer outside the jurisdiction without adequate guarantees.
Purpose:
Data collected via the application form (e.g.: feelings, sleep) is used exclusively to assess the User's eligibility for care programs. It is processed under medical confidentiality.

Liability
Novacare Technologies strives to keep the Site accessible 24/7. However, its liability cannot be engaged in case of technical unavailability, force majeure or occasional inaccuracy of information. The association does not control partner sites (Innovaud, Delta Network, etc.) to which links may refer.
Applicable Law and Jurisdiction
Applicable Law: These T&C are governed exclusively by Swiss Law.
Jurisdiction: In case of dispute, and failing an amicable agreement, exclusive jurisdiction lies in Lausanne (Canton of Vaud), headquarters of the Association and the Innovaud ecosystem, subject to an appeal to the Federal Court.
